This website at wncrd.com (the "Site") is operated by WNC Residential Development LLC, a North Carolina limited liability company ("WNCRD," "we," "us"). By accessing or using the Site you agree to these Terms of Use. If you do not agree, do not use the Site.

2. Informational purpose only

The Site presents general information about WNCRD and its residential development projects. Nothing on the Site is an offer, bid, quote, solicitation, or contract to design, build, sell, lease, or finance any property or to perform any services. Any services are governed solely by a separate written agreement signed by WNCRD.

3. No professional advice

Site content is general information only and is not construction, engineering, architectural, legal, tax, financial, or investment advice. Consult qualified professionals before acting on anything you read here.

4. Project information

Project descriptions, statuses, prices, square footage, dimensions, lot sizes, features, timelines, and any "Developer Blueprint System 360" analysis are illustrative, may reflect a point in time, and are subject to change or error without notice. Square footage and dimensions are approximate. Photographs and renderings may be representative and may not depict an actual property or its current condition.

5. Intellectual property

All text, images, graphics, logos, and other content on the Site are owned by or licensed to WNCRD and are protected by law. You may view and print pages for your personal, non-commercial use. You may not copy, republish, scrape, frame, or use Site content for any other purpose without our prior written permission.

6. Your submissions

If you submit an inquiry through the Site, you represent that the information is accurate and that you have the right to share any files you upload. You grant WNCRD permission to use your submission to respond to and evaluate your inquiry. Do not submit confidential, privileged, or sensitive personal information. Submitting an inquiry does not create any contractor-client, agency, fiduciary, or other professional relationship.

You agree not to use the Site unlawfully, not to interfere with its operation or security, and not to access it by automated means without our permission.

To the fullest extent permitted by North Carolina law, WNCRD and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the Site. Our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (US $100).

11. Indemnification

You agree to indemnify and hold WNCRD harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your breach of these Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Buncombe County, North Carolina, and you consent to their jurisdiction.

13. Changes

We may update these Terms at any time by posting the revised version here, with a new effective date. Continued use of the Site means you accept the changes.

14. Severability; entire agreement

If any provision is held unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and WNCRD regarding the Site.
